Termination of Serbian Citizenship by Release Article 28 of the Law

The citizenship of the Republic of Serbia for a citizen of the Republic of Serbia terminates by release if they submit a request for release and meet the following conditions:

  • They have reached the age of 18.
  • They have no impediments regarding military obligations.
  • They have settled taxes and other legal obligations in the Republic of Serbia.
  • They have regulated property rights obligations arising from marital relations and relations of parents and children towards individuals living in the Republic of Serbia.
  • There are no ongoing criminal proceedings against them in the Republic of Serbia for criminal offenses prosecuted ex officio, and if they have been sentenced to a prison term in the Republic of Serbia, they have served that sentence.
  • They have foreign citizenship or evidence that they will be accepted into foreign citizenship.

To submit a request, the following documents are required:

  • A valid identification document with a photograph.
  • Certificate of citizenship of the Republic of Serbia.
  • Extract from the birth registry.
  • Extract from the marriage registry.
  • Properly certified original of a valid guarantee of acceptance into foreign citizenship or a certificate of acquired foreign citizenship with a translation into the Serbian language.
  • A certificate from the competent basic and higher court indicating whether the person is under investigation and whether criminal proceedings have been initiated for criminal offenses prosecuted ex officio.
  • A certificate from the Special Department for Organized Crime and the Department for War Crimes of the Higher Court.
  • A certificate from the Special Department for Combating Corruption of the Higher Court according to the place of residence (Higher Court in Belgrade/Higher Court in Niš/Higher Court in Novi Sad/Higher Court in Kraljevo).
  • A certificate from the competent department of the Republican Tax Administration regarding settled tax obligations in the territory of the Republic of Serbia.
  • A certificate from the competent local tax administration regarding settled tax obligations in the territory of the Republic of Serbia.
  • A certificate from the competent social welfare center regarding settled obligations arising from marital relations and relations of parents and children.
  • A certificate from the military section regarding the settled military obligation (for males under the age of 60).
  • Consent of the other parent for the release from Serbian citizenship of a minor child (the parent’s signature giving consent must be certified by the competent court or municipal administration body in the country or by the Ministry of Foreign Affairs of the Republic of Serbia), along with a valid identification document.
  • A legally binding court decision on divorce (in cases where the parents are divorced) or a copy certified by the competent authority in the Republic of Serbia or by the Ministry of Foreign Affairs of the Republic of Serbia (in cases where the request is submitted by a parent to whom the child has been entrusted by a legally binding decision for care and upbringing). If a legally binding foreign court decision on divorce is attached, it is necessary to provide a legally binding decision recognizing the foreign court decision issued by the competent authority in the Republic of Serbia.
  • The consent of a minor child over 14 years of age with the request for release from the citizenship of the Republic of Serbia, signed in the presence of an authorized person of the competent authority in the Republic of Serbia or before the diplomatic-consular representation of the Republic of Serbia abroad.
  • A decision on the full adoption of a child in cases when release from the citizenship of the Republic of Serbia is sought for the adoptee until the age of 18 (when the request is submitted by an adopter who is a foreign national, a document confirming foreign citizenship must also be provided).
  • Payment receipt generated on the eGovernment portal.

The competent authority, with the consent of the applicant, may obtain data from official records:

  • Personal status of citizens (birth registry, marriage registry, and death registry).
  • Records of citizens of the Republic of Serbia – a certificate of citizenship of the Republic of Serbia.
  • Other data necessary for decision-making from other official records maintained by the competent authorities of the Republic of Serbia.

If the applicant wishes, they can obtain the mentioned documents themselves and attach them to the submitted request.
